National Data Opt-Out (England only)
The national data opt-out policy allows individuals to decide whether their confidential patient data can be used for research. Under this policy, data collected about individuals in England who have opted out cannot be used for research purposes, even after the individual has died. The policy will continue to apply until the data subject changes their preference, even if the individual moves out of England.
There are some exemptions to the national data opt-out policy, such as when explicit consent to use the data has been granted by the data subject. Researchers who have received Section 251 support will not be able to access data on participants who have opted-out under the policy except in limited circumstances. Further information on exemptions and how to apply the policy can be found in the national data opt-out operational policy guidance document.
